CIETAC Hubei Sub-Commission

During 24 and 25 June, 2017, the lecture on Overview of International Commercial Contract Law and Arbitration Practice was jointly held by CIETAC Hubei sub-commission, law school of Wuhan University and Hubei Corporate Counsel Association in Wuhan successfully. CIETAC senior arbitrator, well-known arbitration expert and former Chairman of the Asia-Pacific Arbitration Organization, Mr. Yang Liangyi gave the keynote speech.

This lecture was the opening event of the mainland lecture series in the midlands. Secretary General of CIETAC Hubei Sub-commission hosted the lecture and Dean of law school of Wuhan university, Mr. Feng Guo, honorary chairman of Hubei Corporate Counsel Association, Mr. Liu Xinquan separately made a speech. More than 400 judges, in-house counsels, lawyers and scholars from Hubei, Hunan, Beijing, Chongqing, Jiangxi, Shanghai attended the lecture.

“The contract does not necessarilyhave signature or seal to form, and more than 90% international commercial contracts was formed without the need to sign or seal.” These words by Mr. Yang Liangyi triggered the interests of all the audience immediately. Mr. Yang firstly brought up the importance of international commercial contract by the maxim--If you know yourself and your enemy, you'll never lose a battle--in Sun Tzu's Art of War, and then introduced relevant concepts of contract from the perspective of common law, explicatedthe and law by combining his own experiences, and made an in-depth analysis of the forming conditions of contract and the rules of interpretation, and also gave a full introduction to several situations of performance and default and damages and remedies, meanwhile, he analyzed the serious problems lying inthe overseas arbitration practice of our country’s enterprises in a targeted way. He particularly pointed out that under the circumstance of international economic exchanges getting close, if want to obtain the initiative from the powerful negotiation rival, you should enhance self-comprehension to common law first to initiatively and effectively avoid legal risks and damages in the transaction.

All the audience gave applause to Mr. Yang for many times when the two-day lecture came to the end, and several attendees queued up to communicate with Mr. Yang on the issues of international arbitration practice for a long time on-site. Meanwhile, Mr. Yang also presented his classical works Construction of Contract and Damages and Remedies as gifts to the audience who would like to know and learn international commercial contract law and international arbitration law.

The lecture was rich in content and full of vigor. All the audience were impressed by the Mr. Yang’s demeanor, vigor and profound knowledge, as well as moved by the patriotism reflecting from the aspiration that hoping Chinese to know international rules well in order to avoid suffering losses or being cheated in international transactions.They successively sent such good compliments as academic feast, hit the mark and simple but profound and so on to sub-commission, expressed appreciation to CIETAC Hubei sub-commission for bringing Mr. Yang, who as a window connecting mainland laws to international commercial laws and rules to Hubei local legal profession and expected to benefit by Mr. Yang’s advice next time.
